Abstract

This article is devoted to the analysis of the legal nature of loan labour (autstaffing, temporary agency work, outsourcing) as one of the forms of non-standard employment emerging in the context of the transformation of modern labour relations. The study examines the concept of loan labour, its main forms, and the specific features inherent in triangular employment relationships. The complex legal nature of loan labour relations, characterized by the interaction of civil law and labour law elements, is substantiated.

In addition, a comparative legal analysis of the relevant documents of the International Labour Organization and the labour law norms of the European Union regulating loan labour is conducted, which substantiates the necessity of harmonizing national legislation with international labour standards. The conclusions of the study propose scientific and practical recommendations aimed at improving the legal regulation of loan labour.
