SOME ISSUES OF FINDING A CITIZEN AS MISSING AND DECLARING THEM AS DEAD

This article examines certain theoretical and practical issues related to the institution of recognizing a citizen as missing and declaring him or her deceased. In the context of globalization and technological development, the study analyzes the justification of statutory time limits for declaring a person deceased, the identification of cases of deliberate concealment, the content of the concept of an “interested person,” and the procedural legal status of creditors. Particular attention is paid to the mechanism of trust management of the missing person’s property and the difficulties in restoring property rights when a citizen declared deceased later returns. The article also assesses the compliance of current civil legislation with the principle of effective protection of human rights. Based on the analysis, scientifically grounded proposals for improving civil legislation are presented.
