Abstract

This article considers the problem of increasing the scope of procedural powers of the defense counsel in pre-trial proceedings, which is closely related to his role in the process of forming the evidence base. In our opinion, granting the defense counsel the right to directly participate in the collection of evidence at the pre-trial stage would significantly increase the effectiveness of legal assistance provided to the participants of criminal proceedings, would contribute to the achievement of objective truth in the case and would maximally guarantee the observance of fundamental rights and legitimate interests of the individual.
