Abstract

This article examines the theoretical interpretation of somatic rights and provides a comparative analysis of their legal regulation in Germany and Uzbekistan. It explores the origins, philosophical foundations, and definitions of somatic rights. Special emphasis is placed on the right to bodily integrity and the right to make autonomous decisions regarding one’s own body, grounded in the theories of internationally recognized scholars such as John Rawls, Ronald Dworkin, as well as Uzbek legal scholars. The article analyzes constitutional protections of somatic rights under the Basic Law of the Federal Republic of Germany, including the rights to life and bodily integrity, along with relevant judicial practice, and reviews the theoretical foundations of somatic rights within the Constitution and national legislation of the Republic of Uzbekistan. By comparing the German and Uzbek legal frameworks, the study identifies key similarities and differences in their approaches to the concept of somatic rights. The conclusion emphasizes the necessity of a comprehensive theoretical approach—based on human dignity, bodily integrity, and bioethical principles—to ensure the effective legal protection of somatic rights.
