Abstract

Discretionary powers are a crucial element of administrative governance in the European Union and the Council of Europe, allowing authorities to make decisions in situations of legal uncertainty. However, their application is restricted by the principles of legality, proportionality, and judicial control, preventing abuse and arbitrariness in decision-making. This article analyzes the legal framework for discretionary powers exercised by the European Commission and specialized EU agencies, exploring mechanisms of oversight, including the Meroni doctrine and case law of the ECJ and ECHR.
